摘要:
由于免费公交车运输管理上的混乱,从法律层面和交通运输学理论层面分析免费公交车运 输行为的性质。分析认为,由于免费公交车运输行为符合经营性运输行为的法律构成要件:服务对 象是面向社会公众的、该运输行为具有商业性,因而免费公交车运输属于经营性运输行为。分析结 果表明:开通免费公交车运输应取得政府的许可。
Abstract:
Because of the chaos in the management of the free public transportation, this paper analysizes the behavior characteristics of free public transportation from legal angle and transportation theory. Through the analysis, it is found that as the free public transportation accords with legal elements of business transportation behavior, its consumers should be the public masses and as it is of business, it should belong to business transportation behavior. Besides, the opening of free public transportation should get approved of by the government.
