摘要:
知识产权垄断是指知识产权人凭借其知识产权的优势地位限制竞争、损害社会利益的行 为。反垄断法应当规制知识产权垄断,而制裁的方法则用解除知识产权垄断。由于知识产权垄断, 产生了信息的垄断,进而形成和发展了市场垄断。它的无形性和“合法性”使传统反垄断法无法规 制。经济全球化迫使中国应当制定反垄断法规制知识产权垄断。
Abstract:
Monopoly of intellectual property is that the monopolist on the strength of upper ascendance to interdict competition and do harm to social benefits. The law of antimonopoly should come to work to release the monopoly. Because of these, monopoly of marketing is on the heels of the monopoly of information. As intellectual property is intangible but legal, it is more difficult to be regulated than corporeal property. Now economic globalization forces China to establish the antimonopoly law to regulate the monopoly of intellectual property.
