摘要:
公民环境权理论自产生以来便在世界上产生了深远的影响。作为一项新型的基本人权,公 民环境权已为世界许多国家所接受和认可。但目前在中国,宪法、环境法、民法等部门法均没有明 确确认公民环境权,造成对公民环境权的保护不力。在立法中明确确认公民环境权具有重要的理 论和现实意义。应当以可持续发展理论为指导,在宪法中规定公民环境权,并在民法中具体规定公 民环境权的基本内容;修改环境法,完善公民环境权的实现方式和救济途径,从而加强对公民环境 权的保护力度。
Abstract:
As a new kind of basic human right, the citizens environmental right has gained wider acceptance and recognition in many countries in the world. But in China, the citizens environmental right has not been confirmed in constitution, environmental law, civil law and other laws. As a result, the protection for the citizens environmental right is very weak. Its very important and necessary to confirm the citizens environmental right in legislation. In order to reinforce and protect the citizens environmental right, it is necessary to add the right to the constitution, confirm the content of the citizens environmental right in civil law and mend the environmental law to ensure its realization and remedy of the citizens environmental right.
