摘要:: 入世后为了促进特许经营在中国的全面发展,我们急需建立、健全符合国际规则和国际惯例的相关法律制度。在立法过程中应结合欧盟国家的相关立法经验,并注意以下三个方面:特许经营应纳入我国反垄断法律规制的范畴;通过制定特许经营条例或实施细则完成特许经营的政府规制;采取政府推进模式促进特许经营的发展。

Abstract:: In order to develop franchising in China after entering WTO, we are urged to set up and accomplish the relevant legal institution according to international rules and custom. In the process of legislation, we can use the rich experience of UN countries for reference. And the following three aspects must be stressed: bringing franchising into anti-monopoly regulation; making franchising rules or detailed rules for implementation; developing franchising in government-improving mode.
