摘要:
目前,世界范围内陪审制度发展呈衰微趋势,中国陪审制度的基本现状不容乐观。中国陪审制 度的基本价值取向应是“通过参审来监督和保证司法公正”;现行陪审制度应从“陪审员选任制度”、 “陪审案件范围”、“陪审员职责”等方面进行改革,使陪审制度成为实施依法治国方略的有力措施。
Abstract:
The tendency of the jury system on the world takes on declination, so does our country's.The writer points that the essence value of our nation's jury system is to supervise trial and guard judicial impartiality by participating in trial. And we must reform our jury system in those fields such as the system of juror election,the scope of jury trial and the liability of juror in order to make sure that jury system should become one of important measurements in our nation's“ rule by law” stratag.
