摘要:
从合同性质、合同类型和合同形式三维角度,运用比较研究方法,对合同诈骗罪中的合同作了较为细致的分析。分析认为,合同诈骗罪之合同只是行为人用以诈骗的手段,其根本目的是骗取他人财物; 合同诈骗罪中的“合同”必须是能够体现市场秩序的合同,有关身份关系的合同应该绝对排除在合同诈骗罪之合同的范围之外; 应该对合同诈骗罪之合同形式作开放性解释,不仅书面合同可以构成本罪,而且口头合同和其他形式的合同也可以构成本罪。
Abstract:
A detailed analysis of contract fraud from the perspective of nature, type and form of the contract is conducted. The conclusion shows that the contract is just a strategy in the circumstance of contract fraud, which is used to defraud others' property. The definition of contract, in this context, is the contract that can reflect the market order. Therefore, the contract that adjusts relationships should be ruled out absolutely. In addition, the contract fraud in criminal law, should be interpreted from an open perspective, which means that both oral and written contracts will constitute the crime of contract fraud.
