摘要:
为探索海峡两岸司法协助的有效路径,运用比较分析方法综观《海峡两岸共同打击犯罪及司法互助协议》签订前后海峡两岸司法协助制度的演变,重点分析该协议所确定的刑事及民事司法协助内容及方式、海峡两岸司法协助的巨大进展及今后的发展趋势。分析认为,作为海峡两岸司法协助的重要阶段性成果,该协议的内容尚需进一步完善,其中特别是对司法管辖权冲突及互助中的法律冲突等问题,海峡两岸亟需达成更大范围的共识。
Abstract:
As the first comprehensive cooperation agreement in the field of cross-strait judicial assistance, Agreement of Jointly Cracking down on Crime and Mutual Legal Assistance Across the Taiwan Strait is the summary of two sides practice of judicial assistance which lasts for many years. As the evolution of cross-strait judicial assistance is concerned before this agreement was signed, and after the specific contents and manners of mutual legal assistance identified by this agreement are analyzed, it is found that there is significant progress in cross-strait mutual legal assistance. And though it is an important achievement in cross-strait mutual legal assistance, the contents of the agreement still need to be further improved. The two sides need to form a wider consensus on the coordination of the conflicts of judicial jurisdiction and the legal conflicts which still exist in the judicial assistance.
