摘要:
中国西部地区在诉讼文化的转型中出现了传统诉讼观念和现代诉讼制度的冲突。为实现 诉讼观念和诉讼制度和谐发展,有效解决各种纠纷,在对诉讼文化进行对比和实证分析的基础上, 研究诉讼文化地域特殊性的原因及其表现。分析表明:由于历史、经济和地理等多方面因素的影 响,诉讼文化的地域特殊性主要表现在民事纠纷、诉讼观念、诉讼制度和民族法制等方面。
Abstract:
In Chinas west regions, there are conflicts between procedural idea and procedural system in the changing proceedures of procedural culture. In order to achieve harmonious development between procedural idea and procedural system and effectively solve the disputes, this paper through contrast and analysis for procedural culture, researches the display and reasons of the district speciality of the procedural law culture. The research indicates that because of the effects of history, economy and geography, the district speciality of the procedural law culture manifests in such aspects as civil dispute, procedural idea, procedural system, nation custom law and so on.
