摘要:
普遍人权的普遍性在主体上表现为它的属人性,即平等地为每个人所享有。古典人权的主 体封闭性使人权的普遍性原则在实践中不能得到贯彻,人权的普遍性原则出现理论与实践的脱节。 普遍人权的主体开放性不是通过一个普适的标准来展现人权的普遍性,而是通过人权享有主体本 身的广泛性来为这种普遍性原则的贯彻提供现实的感性基础。集体人权的主体可能性是普遍人权 主体开放性的逻辑延伸和实际展开。
Abstract:
Universality of common human rightsisexpressed by its humanity in main body.Main body closing of classical human rights makes universality difficult to be carried out in practice, so theory and practice of universality of common human rights are not well linked. Main body opening of common human rights does not reveal universality through a common standard but through the prevalence of main body sharing human rights. Main body possibility of community human rights is the logic extension and actual spreading of common human rights main body.
