摘要:
通过对商标反向假冒行为的性质进行分析,指出商标反向假冒行为是商标侵权行为的一 种。强调了在商标法中对反向假冒行为予以明确规定的必要性。结合2001年《中华人民共和国商 标法》中对反向假冒行为的规定,提出了新的看法。
Abstract:
Through analyzing the nature of trademark's counterfeit, it points out that trademark's counterfeit is one kind of infringement of trademark right,and emphasizes the necessity of clear statement of the counterfeit in Trademark Law.On the basis of this,new viewpoint over the statement of counterfeit in the Trademeark Law of the People's Republic of China published in 2001 is put forward.
