摘要:: 统一合同法的颁行填补了我国行纪合同实践法律调整的空白,确立了行纪合同立法的大陆法系模式。评析了我国行纪合同立法对英美法系直接介入权制度的导入和创新,并设想行纪人担保履行责任的约定主义立法模式以进一步完善行纪合同立法。

Abstract:: The promulgated uniform contract law has supplied the gap of legal adjustment on commission contract. It has also established the civil law mode of commission contract law. The introduction and innovation of the device on intervention right in commission contract law are reviewed. It is stated that the commissioner's duty of direct performance is based on the agreement of the contractual parties.
