摘要:: 国际法体系的日益丰富使得条约解释问题日趋复杂。在国际争端裁决机构和国内法院的适用条约中，不可避免地会涉及条约用语含义、条约间关系的解释问题以及条约解释主体、解释的效力等问题。中国尚缺乏明确的条约国内法解释的程序保障。在ＷＴＯ中与国内立法有关的事项被认为是事实问题，由于存在着与翻译有关的某些不确定性，对事实的确定会受到限制。对于中国《缔结条约程序法》中的条约解释条款应予以修订，以明确条约在中国国内的解释主体、解释程序以及条约翻译等相关问题。

Abstract:: As a result of the increasing sophistication of the international law system, the treaty interpretation is becoming more and more complex. In the applicable treaty of international dispute adjudication institutions and domestic courts, the issues on the interpretation of the treaty’s meanings and the relationship between treaties, as well as the subject and the effect of treaty interpretation are inevitably involved. The domestic legislation lacks procedural guarantee of treaty interpretation. Matters related to domestic legislation in WTO is considered as the matter of fact. The determination of facts will be restricted due to some uncertainty related to translation. The items of treaty interpretation in Law of the People’s Republic of China on the Procedure of the Conclusion of Treaties should be revised to determine the treaty domestic interpretation subject, procedure, treaty translation and the relevant problems.
