Abstract:
In order to properly determine the formation and effect conditions of the contract, the conclusion on the nature of the contract should be given. The analysis shows that the nature of the contract under different conditions should be taken as the civil juristic act in origin, that in tradition and that in Chinese legislation according to civil theory and Chinese legislation. Accordingly, the formation and effect conditions of the contract vary with the nature of the contract.
