Abstract:
Death penalty is the most severe punishment in the system of criminal penalty. Death penalty in China 's penalty code is not abolished, but its application is, meanwhile, strictly limited. This manifests the policy of cautious application of death penalty. The operation and abolition of death penalty should be determined by specific situations and the reality requirements of social development. So when the law is under legitimation, the social development should be taken into account, and constant reformation and promotion should be made to the system of death penalty, and its application should be strictly confined in a certain scope.
