Abstract:
This pape,in view of the controversy about legal certainty, studies the evolution process of the internal relationship between human reason and legal certainty. An in-depth analysis contends that the crisis in the field of law is an inevitable kind of crystallization of the crisis. Therefore, to secure the certainty of law, the endeavors should be made to imbue the legal certainty with new epoch connotations in the light of reflections upon the “human reason”, whereas there is a need to enhance the awareness of the cross-cultural differences in context for the legal certainty questioned and to hold on to transcendence of Chinese rule of law in moderate measures.
